Purpose and scope

These terms apply to the services shown in the accepted quote: catamaran rental, event services and additional services for individuals, families, groups, associations or businesses. The quote specifies the vessel, date, duration, number of participants, included services, options and price. The contract identifies the legal entity providing each service. CELVINE SARL is separate from MADIN’CATA SASU, the lessor of REV’ANOU when that vessel is specified.

Booking and payment

A booking is confirmed once the dated quote has been signed with the words ‘Agreed’ and a 50% deposit has been paid. The balance is due 30 days before departure. If the booking is made after that deadline, the full price is due on confirmation. Payment may be made by bank transfer as instructed in the quote. Services added later may be invoiced separately.

Cancellation by the customer

More than 6 months before departure: the deposit is refunded after a €250 administration fee is deducted. From 6 months to 1 month before departure: the 50% deposit is retained. Less than 1 month before departure, or in case of no-show: 100% of the rental price is due. The administration fee is deducted from any refundable deposit, up to the amount received, and is not automatically added to other penalties. Mandatory legal rules continue to apply.

Force majeure or serious event

If an exceptional, duly evidenced event prevents performance, the situation is assessed in light of the event, commitments already made and applicable law. Supporting documents may be requested. A postponement or credit may be offered with the customer’s agreement; statutory refund rights are not excluded. Illness or a personal impediment does not automatically constitute force majeure.

Weather, safety, postponement and refund

An initial weather check may take place about 72 hours before departure. Forecasts can change and do not necessarily amount to a final decision. Cloudy weather or occasional rain alone does not justify cancellation when sailing remains safe. If the service cannot be carried out safely, a postponement is offered. If no agreement is reached, the unperformed service is refunded in accordance with the contract and applicable statutory rights.

Authority of the person in command and itinerary

The person responsible for navigation decides which measures are necessary for safety. They may change the itinerary, moorings, times or activities, or stop navigation. Advertised itineraries are indicative; sightings of turtles, dolphins or other wild animals cannot be guaranteed.

With or without a skipper

For REV’ANOU, MADIN’CATA offers a bareboat pleasure rental. The renter may choose and engage an independent professional skipper directly, subject to applicable rules and the vessel’s insurance. That service is covered by a separate agreement and invoice; by itself it does not turn the rental into a crewed commercial cruise organised by the lessor. A cook may also be engaged separately, as specified in the quote. For partner vessels, the designated operator’s arrangements apply.

Nautical competence and sailing area

For a bareboat rental, the renter appoints a competent person in command. Before each rental, MADIN’CATA checks the vessel’s seaworthiness, safety equipment and authorised capacity. Without a professional skipper, the renter completes a nautical experience questionnaire and provides relevant supporting documents; the lessor may assess whether their skills suit the proposed voyage. Permitted sailing areas are stated in the contract and remain subject to insurance limits, the lessor’s instructions and local rules. Entering or leaving a port or anchorage at night is prohibited unless authorised in writing and compliant with regulations. Customs formalities and cyclone restrictions must be observed.

Participants and vessel capacity

The number of adults and children must be communicated by the deadline in the quote. The number on board must never exceed the vessel’s authorised capacity for the relevant type of operation. Any change in numbers may require the offer to be adjusted, subject to agreement and availability.

Children on board

Children remain under the constant supervision of their parents or responsible adults, particularly while moving around, swimming or taking part in water activities. Safety instructions and requirements for personal flotation equipment must be followed.

Swimming and water sports equipment

The availability of paddleboards, floats, tenders and other equipment depends on the vessel and the quote. Their use depends on the day’s conditions and permission from the person in command. Each participant must follow safety instructions and disclose any information relevant to taking part in an activity.

Times and delays

The customer must respect the meeting place and time. A group’s late arrival does not automatically delay the return time; the programme may be adapted to navigation constraints. Delays in returning the vessel must be reported immediately and may result in the justified charges set out in the specific contract.

Meals, drinks and allergies

Food and drinks are included only when expressly stated in the quote. The customer must report allergies, intolerances and dietary requirements in advance. Rules on bringing personal food and drinks depend on the vessel and service. Alcoholic drinks are reserved for adults and consumption must remain compatible with safety.

Alcohol and conduct on board

The person in command may limit or stop unsafe alcohol consumption. Participants must respect the vessel, other people, equipment and instructions. Dangerous or violent conduct may lead to interruption of the service or disembarkation in conditions compatible with safety and applicable law.

Included services, options and third parties

The quote details the catamaran rental, any independent professional skipper, cook, meals, drinks, catering, decoration, photography, entertainment and transfers. Provisioning may be offered on request: purchasing supplies, preparing shopping and delivering or loading them according to the chosen arrangement. The cost of purchases and any service charges are itemised in the quote. No service is included unless expressly stated in the accepted quote. The contractual provider and corresponding invoicing are identified.

Fuel, stopovers and sailing expenses

Unless the quote states otherwise, fuel, tender fuel, gas, consumables, port and mooring fees, taxes, formalities and park fees are payable by the renter. Provisioning is not included by default: the customer may purchase supplies themselves or request an optional provisioning service, subject to a quote stating the cost of supplies and any preparation and delivery charges. Fuel and consumable levels may be recorded at departure and return.

Vessel used and substitution

If the vessel becomes unavailable, unseaworthy or cannot be delivered as contracted, the relevant provider informs the customer without delay and, depending on the circumstances, offers a vessel of comparable characteristics, a postponement accepted by the customer, or a refund of amounts relating to the unperformed service. A material substitution cannot be imposed without the customer’s agreement; statutory rights remain unaffected.

Insurance, security deposit and excess

For REV’ANOU, the contractual security deposit is €5,000, subject to the specific rental contract and insurance terms. Optional excess reduction insurance may be offered under the insurer’s conditions, exclusions and evidence requirements; it does not remove the deposit or all of the renter’s liability unless the insurance contract expressly says so. Misappropriation or failure to return the vessel is excluded from the endorsement provided. Bodily injury and passengers’ personal belongings are not necessarily covered.

Handover and inventory

Handover requires payment of amounts due, provision of the security deposit and signing of the inventory and jointly recorded condition report. The lessor provides a seaworthy, equipped vessel with the required documents. The renter must report any anomaly immediately and keep useful evidence, including photographs, the inventory and observations. Any further checks take place within the period stated in the specific contract.

Damage, incidents and repairs

Any breakdown, collision, grounding, flooding, fire, injury, equipment loss or other incident must be reported immediately to the lessor and, where needed, to the authorities and emergency services. The renter must take protective safety measures and follow the lessor’s instructions; significant non-urgent repairs must not be undertaken without consent. For a serious incident, a sea report and any relevant statements, photographs and insurance evidence are prepared. The rental contract must be available to the insurer in the event of a claim.

Return, cleanliness and equipment

The vessel is returned to the agreed port on the contractual date and time, with a joint inventory and condition report wherever possible. Unless the quote states otherwise, fuel, tender fuel, water and consumables are restored to the levels recorded at departure. Final cleaning is mandatory and charged separately on its own line in the accepted quote. That fee covers normal cleaning after normal use but does not remove the renter’s duty to return the vessel reasonably clean, with dishes washed, waste removed and the kitchen, toilets and living areas in normal condition. If the vessel is returned in an abnormally dirty condition requiring exceptional cleaning, the additional costs actually necessary, reasonable and evidenced may be charged and deducted from the deposit after a joint inspection where possible and a detailed statement. Material damage, delays and other potential deductions require separate justification within the contract and applicable law. The remaining deposit is returned under the contractual arrangements and any documented needs arising from an insurance claim.

Damage and personal belongings

Damage attributable to a participant may give rise to a justified claim within the limits of applicable law. Each person remains responsible for their personal belongings, which are not necessarily covered by the vessel’s insurance.

Responsibilities, complaints and disputes

CELVINE, MADIN’CATA, partner lessors and independent providers each assume the obligations under their respective contracts. No clause excludes mandatory liabilities. Any difficulty should be reported as soon as possible and then in writing with supporting evidence. An amicable solution is sought; consumer rights and applicable mediation rules remain unaffected.

Acceptance and distance booking

The CELVINE website allows customers to request a quote without paying online. A contract may nevertheless be concluded remotely through written acceptance of the quote and payment by bank transfer. Contract documents are supplied before the customer commits. The right of withdrawal and any exceptions depend on the service actually sold and applicable regulations.

Logbook and navigation records

For rentals lasting several days, the person in command keeps the supplied logbook up to date with stages, times, weather observations, incidents, significant manoeuvres, damage, equipment losses and important communications. Events are reported to the lessor and reviewed during the return inventory.

Optional customer insurance

Cancellation insurance, personal accident insurance for people on board or excess reduction may be offered by a third-party insurer where available. Subscription is optional unless a particular requirement is expressly stated in the quote and permitted by law. Cover, exclusions, price and claim arrangements are governed exclusively by the insurer’s contractual documents; CELVINE and MADIN’CATA do not guarantee compensation merely by providing this information.

Consumer mediation

After sending a written complaint to the company named in your quote or contract, if no amicable resolution is reached, you may refer the matter free of charge to the consumer mediator. CELVINE SARL and MADIN’CATA SASU have each appointed Société de la Médiation Professionnelle.
